These Terms and Conditions set out the basis on which Waste Collection Clapham provides waste collection and related services to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any order for waste collection.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means any individual, company, partnership or organisation that requests or uses our waste collection services.

Company, we, us or our means Waste Collection Clapham, the provider of the waste collection services.

Services means any waste collection, removal, disposal, recycling or related services provided by the Company.

Waste means any rubbish, refuse, junk, bulky waste, garden waste, commercial waste or similar materials presented for collection by the Customer, excluding any prohibited or hazardous items as set out in these Terms and Conditions.

Service Area means the geographical areas in which we offer our waste collection services, including but not limited to Clapham and surrounding districts, as may be amended from time to time.

2. Scope of Services

2.1 The Company provides waste collection services for household and commercial premises within the Service Area, subject to availability and these Terms and Conditions.

2.2 Our services may include one-off waste clearances, regular scheduled collections, bulky item removal, garden waste removal and commercial waste collection. The specific service type, frequency and scope will be agreed with you during the booking process.

2.3 We reserve the right to refuse collection of any waste that, in our reasonable opinion, is hazardous, improperly packaged, unlawfully stored or otherwise unsuitable for collection or transport.

3. Booking Process

3.1 Bookings for waste collection in Clapham and the wider Service Area can be made by telephone or other communication methods made available by the Company from time to time.

3.2 When making a booking, you must provide accurate and complete information, including your name, contact details, collection address, description and approximate volume or weight of the waste, access details and any special instructions.

3.3 The Company will provide an estimated price based on the information supplied. This estimate may be revised if, on arrival, the waste type, volume, access or other conditions differ materially from the information provided at the time of booking.

3.4 A booking is only confirmed when the Company has accepted the order and, where required, received any applicable deposit or prepayment. We reserve the right to decline any booking at our discretion.

3.5 The Customer is responsible for ensuring that an authorised person is present at the premises at the agreed collection time, unless we have agreed to collect the waste in their absence. Where we agree to attend without the Customer present, the Customer authorises us to access the designated collection area and remove the agreed waste.

4. Access and Collection Conditions

4.1 The Customer must ensure that the collection point is safe, accessible and compliant with relevant health and safety requirements. This includes providing clear access to the waste, adequate lighting, and safe routes for lifting, carrying and transporting items.

4.2 The Customer must ensure that any necessary permits, consents or permissions are obtained where required, including for collections from restricted zones, controlled parking areas or private land.

4.3 If we are unable to complete a collection due to inadequate access, unsafe conditions, incorrect information or absence of the Customer where their presence is required, we may charge a wasted journey fee to cover our reasonable costs.

5. Customer Responsibilities Regarding Waste

5.1 The Customer warrants that they are the owner of the waste or have the authority of the owner to arrange its collection and disposal.

5.2 The Customer must separate and identify any items that may be hazardous, restricted or require special handling, such as chemicals, solvents, oils, asbestos, clinical waste, gas cylinders, explosives, liquids or electrical items that are not permitted under applicable regulations.

5.3 The Customer must not present for collection any waste that is illegal to transport or dispose of under applicable environmental and waste management laws in the United Kingdom.

5.4 The Company may, at its sole discretion, refuse to collect any waste that appears to be hazardous, contaminated or in breach of these Terms and Conditions. Where possible, we will inform you of any such refusal and any additional options available, which may incur further charges.

6. Pricing and Payments

6.1 Prices for waste collection services are based on factors such as the type and volume of waste, the nature of the items, access conditions, labour required and distance travelled within or around the Service Area.

6.2 Any price quoted prior to collection is an estimate only, based on the information provided by the Customer. The final price will be calculated once our team has inspected the waste and confirmed the volume, type and work involved.

6.3 All prices are quoted in pounds sterling and may be exclusive of VAT, where applicable, which will be added at the prevailing rate.

6.4 Payment is due on completion of the collection, unless we have agreed alternative payment terms in writing. We may require a deposit or full prepayment for certain services, including large or specialist collections.

6.5 Payment methods accepted will be communicated during booking and may include cash, card or other forms of electronic payment. The Customer is responsible for ensuring that funds are available and that payment details are correct.

6.6 In the event of late or non-payment, the Company reserves the right to charge interest on any overdue amounts at the statutory rate allowed under UK law and to recover any reasonable costs incurred in the collection of such sums.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company during normal working hours.

7.2 If you cancel a booking with at least 24 hours notice prior to the scheduled collection time, no cancellation fee will normally be charged, and any prepayment may be refunded subject to our discretion.

7.3 If you cancel with less than 24 hours notice, or fail to provide access at the agreed time, the Company may charge a cancellation fee or retain all or part of any prepayment to cover our reasonable costs, including staff and vehicle allocation within the Service Area.

7.4 Any request to amend the date, time, location or scope of a booking is subject to availability and the Company’s agreement. Changes may affect the price initially quoted.

8. Performance of Services and Service Standards

8.1 The Company will make reasonable efforts to perform the services at the agreed date and time. However, all times given are approximate and may be subject to change due to traffic, weather conditions, vehicle breakdown, staff availability or other factors beyond our control.

8.2 If we anticipate a significant delay or need to reschedule your collection, we will take reasonable steps to inform you as soon as practicable and agree an alternative arrangement.

8.3 The Company will carry out the waste collection services with reasonable care and skill, in accordance with applicable laws, environmental regulations and industry standards.

9. Waste Handling and Environmental Compliance

9.1 The Company is committed to responsible waste management and will transport and dispose of collected waste in accordance with applicable UK legislation, including environmental protection and waste duty of care requirements.

9.2 Depending on the type of service, we may transport waste directly to licensed disposal or recycling facilities. Where practicable, we will prioritise re-use and recycling options in order to minimise landfill.

9.3 Upon collection, title to the waste may pass to the Company, subject to applicable regulations. However, this does not relieve the Customer of their duty to ensure that waste presented is lawful and compliant with these Terms and Conditions.

9.4 The Customer acknowledges that they have a legal duty of care regarding the waste they produce. By using our services, you authorise us to handle, transport and arrange disposal or recovery of your waste in compliance with UK waste regulations.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter in respect of which liability cannot lawfully be limited or excluded.

10.2 Subject to clause 10.1, the Company shall not be liable for any indirect, special or consequential loss or damage, or for any loss of profit, revenue, business, contracts, goodwill or anticipated savings, whether arising in contract, tort, negligence or otherwise.

10.3 Subject to clause 10.1, the Company’s total aggregate liability to the Customer in respect of any claim arising out of or in connection with the services shall be limited to the total price paid or payable by the Customer for the specific collection giving rise to the claim.

10.4 The Customer is responsible for removing or protecting any items not intended for collection and for pointing out any fragile or high-value items that could be affected by the waste removal process. We shall not be liable for damage to items that were not reasonably identifiable or that were not clearly indicated to us as fragile or valuable.

10.5 The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events, circumstances or causes beyond its reasonable control, including but not limited to severe weather, accidents, road closures, strikes, or the actions of third parties.

11. Complaints

11.1 If you have any concerns or complaints about our waste collection services, you should contact us as soon as possible, providing full details of the issue, the date of service and any supporting information.

11.2 We will investigate complaints in a fair and timely manner and may request further information from you to assist in our review.

11.3 Where a complaint is upheld, we may, at our discretion, offer a remedy which may include a partial refund, a re-visit to complete or rectify the service, or another appropriate solution.

12. Data Protection and Privacy

12.1 The Company will collect and process personal information from Customers for the purposes of providing waste collection services, managing bookings, handling payments, and complying with legal obligations.

12.2 We will take reasonable steps to protect your personal information and will not sell or disclose it to third parties except where necessary to provide the services, comply with the law, or with your consent.

13. Changes to these Terms and Conditions

13.1 The Company reserves the right to amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date of the change.

13.2 For ongoing or scheduled services, we will provide reasonable notice of any significant changes that may affect your existing arrangements.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of waste collection services.

15. General Provisions

15.1 If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court or competent authority, that provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

15.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

15.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company.

15.4 These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the provision of the services and supersede any prior agreements, understandings or arrangements, whether oral or written.
